Terms of Service

1. About Us

The NetFalcon Creations platform (the “Service”) is operated by NETFALCON CREATIONS - FZCO, a free zone company registered in the United Arab Emirates, with registered address at NETFALCON CREATIONS, IFZA Business Park, Building A1, Dubai, United Arab Emirates. References to “we”, “our”, or “us” mean NETFALCON CREATIONS - FZCO. References to “you” or “Client” mean the individual or entity accessing the Service.

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance of the updated Terms.

3. Account Registration

  • You must provide accurate, current information when creating your account.
  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher.
  • We may suspend or terminate accounts that violate these Terms, misuse the Service, or engage in fraudulent activity.

4. Credits and Payments

The Service operates on a pay-as-you-go credit system. One credit is approximately equivalent to one US cent (exact rate shown on the pricing page). Credits are consumed as you generate content. Key rules:

  • Credits are non-transferable between accounts.
  • Credits do not expire unless your account is terminated for breach of these Terms.
  • You may top up credits via Stripe card payment or bank transfer. Bank transfer credits are added manually after we verify receipt (usually within 1 business day).
  • All prices are in USD unless otherwise stated. You are responsible for any applicable taxes in your jurisdiction.
  • New accounts receive a one-time welcome grant of free credits at our discretion; this amount may change without notice.

5. Refunds

Unused credits are refundable within 30 days of purchase. Refund requests must be sent to contact@netfalconcreations.com and include your account email and the transaction reference. Refunds are issued to the original payment method. Credits that have been used to generate content are non-refundable. Custom enterprise arrangements may have separate refund terms specified in writing.

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, fraudulent, defamatory, obscene, or infringes intellectual property rights.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Make false advertising claims about products you promote using assets we generate.
  • Attempt to reverse engineer, scrape, or circumvent the Service's technical protections.
  • Resell, sublicense, or distribute access to the Service without our written permission.
  • Use the Service to generate content about minors in inappropriate contexts.
  • Overload the Service with automated requests beyond reasonable use.

7. Content Ownership

Your content: You retain all rights to product information, brand assets, and data you upload to the Service. You grant us a limited license to process this content solely to deliver the Service to you.

Generated outputs: Ad copy, images, videos, landing pages, and other assets generated by the Service become your property once generated and paid for. You are responsible for ensuring the outputs comply with the advertising policies of any platform you use them on (Meta, TikTok, Google, Shopify, etc.) and with applicable laws.

Platform IP: The Service itself, including its software, design, prompts, and branding, remains our property.

8. Third-Party Services

The Service integrates with third parties including OpenAI, Anthropic, Creatify, Stripe, Clerk, Meta, TikTok, and Shopify. Your use of those integrations is also governed by their respective terms. We are not responsible for outages, pricing changes, or policy changes by third parties that may affect Service availability.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee that generated content will produce any particular business outcome (sales, ROAS, conversion rates). AI-generated content may occasionally contain inaccuracies — you are responsible for reviewing all outputs before using them publicly.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption.

11. Termination

You may close your account at any time by contacting support. We may terminate or suspend accounts that breach these Terms, misuse the Service, or fail to pay outstanding invoices. Upon termination, unused credits may be refunded at our discretion (subject to clause 5).

12. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved in the courts of the Emirate of Dubai, UAE, unless applicable law requires otherwise for consumer protection in your jurisdiction.
